Special District Meeting Minutes – DRAFT                                           April 2,  2009

 

Subject: North East Cove (N E Cove)

 

Start Time: 7:00pm

 

Meeting Objectives: Discuss problem with N E Cove, then act on any motions

 

Part A: Discussion

 

Introduction: Dave O’Brien states issues with N E Cove.

 

Background on cove situation: Reggie Miles provided background and a chronology of actions which have effected the current situation in the cove.

 

Dr. George Knoecklein provided comments on the results of testing samples from the cove and answered questions from members of the ALD Board of Directors (BoD) and residents.

 

Dave O’Brien described actions the BoD has recently taken to address the issues identified in the cove. These include engaging the Town of Lebanon, the CT DEP, the CT Department of Health.

 

There was a general discussion of these actions and the responses of these actions by the various agencies and the Town of Lebanon.

 

Part B: Consider and Act

 

First Motion:

 

A. Do ongoing testing every 2 to 3 weeks in the problem area.

 

B. Look into appropriate containment at site of the active seep in N E Cove subject to property owner approval.

Second Motion:

 

A. Give the Town of Lebanon three weeks to work with the CT DEP.  ALD BoD will receive an assessment of their (the Town) actions from the DEP.  If the town is cooperating with the DEP on the sewer implementation plan (a revised implementation plan is in place), the ALD BoD will not go to CT Attorney General.  If they are not cooperating, ALD BoD president will contact Attorney General.

Third Motion:

 

A. ALD BoD to ask Pullman and Comley to research appropriate actions to get access to private properties and surrounding lots to permit septic testing and to receive the results of that testing.

A. By the next ALD BoD meeting if the Town of Lebanon is not working with BoD to come up with a plan to clean up N E Cove, then the BoD is empowered to pursue legal action up to and including contacting the CT Attorney General.
